Terms of Service

1. Agreement to Terms
These Terms of Service (“Terms”) govern your use of the Polished Ads platform, website, and services (the “Service”) operated by Polished Ads (“Polished,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.
2. What Polished Is
Polished is a marketplace that connects advertisers (brands looking for ad creative) with creatives (people who produce video ads). Advertisers post bounties describing what they need. Creatives submit finished ads. Approved ads are deployed to the advertiser’s connected ad accounts.
We facilitate the connection, payment processing, and ad deployment. We are not a party to the creative work itself — we provide the infrastructure for advertisers and creatives to work together.
3. Accounts
You must be at least 18 years old to use the Service. You’re responsible for keeping your account credentials secure and for all activity under your account. Please let us know right away if you suspect unauthorized access.
You can register as an advertiser, a creative, or both. You agree to provide accurate information during registration and to keep it current.
We reserve the right to suspend or terminate accounts that violate these Terms, are inactive for extended periods, or engage in fraudulent or abusive behavior.
4. For Advertisers
Posting bounties
When you post a bounty, you’re committing to the payment terms you set (base payment per accepted submission, format fees, and performance terms). You fund bounties through Stripe when posting.
Reviewing submissions
You’re responsible for reviewing submissions in a timely manner. Approved submissions trigger payment to the creative. Rejection should include good-faith feedback when possible.
Ad account access
By connecting your Meta ad account, you authorize Polished to create campaigns, upload ad creative, and manage ads within the parameters you’ve configured. You can disconnect your account at any time, but ads already deployed will remain until you remove them from Meta directly.
Content rights
When you approve a submission, you receive a license to use that creative for advertising purposes on the platforms specified in the bounty. The specific license scope is defined at the bounty level. The creative retains ownership of their original work unless otherwise agreed in writing.
5. For Creatives
Submissions
By submitting content, you represent that it’s your original work (or that you have the rights to use all elements in it), that it doesn’t infringe anyone else’s intellectual property, and that it complies with the bounty requirements and applicable advertising regulations.
AI-generated content
If your submission uses AI-generated elements, you must label it accordingly. You’re responsible for ensuring AI-generated content complies with all applicable laws and platform policies.
Format jobs
When you claim a format job, you’re committing to deliver the required format variants within a reasonable timeframe. Unclaimed format jobs return to the open queue.
Payments
Base payments are released when your submission is approved. Format fees are released when your format job is approved. Performance earnings accrue based on ad spend tracked via Meta’s API and are settled on a regular schedule (typically weekly or bi-weekly), subject to a reconciliation period.
You’re responsible for setting up and maintaining your Stripe Connect account for receiving payouts. You’re responsible for any taxes owed on your earnings.
6. Payments & Fees
All payments are processed through Stripe. Polished may charge a platform fee (a percentage of each transaction). Current fee rates are displayed on the platform before you commit to a transaction.
Refunds are handled on a case-by-case basis. If a submission is approved but later found to violate these Terms (e.g., it contains infringing content), we may reverse the payment.
We aim to process payouts promptly, but delays can occur due to Stripe processing times, fraud checks, or reconciliation periods. We’ll communicate any significant delays.
7. Content & Conduct
You agree not to:
- Submit content you don’t have the right to use.
- Upload content that is misleading, defamatory, obscene, or illegal.
- Submit duplicate or recycled content across multiple bounties without disclosure.
- Use watermarked stock footage, copyrighted music, or trademarked elements without proper licenses.
- Manipulate performance metrics, engagement, or ad spend data.
- Create multiple accounts to circumvent restrictions or exploit promotions.
- Reverse-engineer, scrape, or attempt to extract data from the Service beyond normal use.
- Harass, threaten, or abuse other users.
We may remove content and suspend accounts that violate these rules. We try to give warnings for minor issues, but reserve the right to act immediately for serious violations.
8. Intellectual Property
Your content: You retain ownership of content you create and submit. By submitting content through the Service, you grant Polished a limited license to host, display, and transmit that content as needed to operate the marketplace (e.g., showing submissions to advertisers, deploying ads to Meta).
Our platform:The Polished platform, branding, design, and underlying technology are owned by Polished. These Terms don’t grant you any rights to our trademarks, logos, or proprietary technology.
9. Third-Party Services
The Service integrates with third-party platforms including Meta (Facebook/Instagram), Stripe, and Clerk. Your use of these services is also governed by their respective terms and privacy policies. We’re not responsible for third-party service outages, policy changes, or actions taken by those platforms.
10. Disclaimers
The Service is provided “as is” and “as available.” We work hard to keep things running smoothly, but we don’t guarantee that the Service will be uninterrupted, error-free, or that it will meet every specific need.
We don’t guarantee any particular level of ad performance, earnings, or return on investment. Advertising results depend on many factors outside our control, including ad quality, targeting, market conditions, and platform algorithms.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
To the maximum extent permitted by law, Polished’s total liability for any claims arising from your use of the Service is limited to the amount you’ve paid to or received from Polished in the 12 months before the claim arose, or $100, whichever is greater.
We’re not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we’ve been advised of the possibility.
12. Indemnification
You agree to indemnify and hold Polished harmless from claims, damages, and expenses (including reasonable attorney’s fees) arising from your use of the Service, content you submit, or your violation of these Terms.
13. Dispute Resolution
We’d prefer to resolve disputes informally first. If you have a concern, contact us at support@polished.adsand we’ll try to work it out.
If we can’t resolve it informally, any disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You agree to arbitrate on an individual basis — class actions and class arbitrations are not permitted.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
14. Changes to These Terms
We may update these Terms from time to time. We’ll post the updated version here and change the “Last updated” date. For material changes, we’ll try to give you reasonable notice (via email or an in-app notification). Continued use of the Service after changes constitutes acceptance.
15. General
- If any part of these Terms is found unenforceable, the rest still applies.
- Our failure to enforce a right doesn’t waive it.
- You can’t transfer your rights under these Terms without our consent. We can transfer ours in connection with a merger, acquisition, or sale of assets.
- These Terms, together with our Privacy Policy, represent the entire agreement between you and Polished regarding the Service.
